The Contract and Claims Manager leads the provision of contract management services, ensuring all contract management activities are executed in accordance with the relevant group division business directives and instructions including company procedures and the contract management framework.
This position reports to Finance Manager Your responsibilities Ensures that the portfolio of contracts in the business, follows contract and claim management methodologies in accordance with internal standard procedures.
Develops contract strategy based on ABB’s policies, customer requirements, and the overall execution strategy, considering the risk, pricing, scope, and schedule.
Identifies the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule, and other documents incorporated in the contract) and highlights the areas of potential risk.
Ensures timely and accurate execution of commercial aspects in the portfolio of contracts (i.
., payments, claims, variation orders, warranties, provisions, guarantees, etc.).
Establishes and enforces standard change methodologies in the portfolio of contracts to identify changes and quantify the additional time and compensation due for ABB as per the contract, defines approval requirements, and communicates changes to the customer.
Enforces and defends ABB's contractual interests against customers and suppliers throughout the project lifecycle, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims.
Notifies and liaises with the Legal team to report major claims and keeps them updated of any critical development during project execution.
Supports in drafting of purchase orders, contracts, and subcontracts, and ensures that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow-down of main contract terms.
Analyzes the contract terms to highlight the areas of potential opportunity and risk, such as ambiguities, omissions, and conflicts, throughout the course of work.
Develops and implements risk mitigation and opportunity plan, in concert with the Global Project Operations Manager, Global Business Unit Manager, and/or Global Product Group Manager.
Ensures contract insurance provisions are adhered to and coordinates with Insurance Risk Management team regarding occurrences that may be covered by customer or ABB provided insurance.
Seeks advice from the Legal (Export Control) team to ensure accurate handling of all export control matters and ensures close review of all contracts and projects with respect to restrictions on exports, by considering countries, customers, or products involved and the respective laws and ABB regulations.
Your background Bachelor's degree preferrable but not limited to Law, Business or Engineering degree.
Specialization in Contract Management is a plus.
Experience with contract risk management for large projects is required.
SAP ERP knowledge will be a plus.
Fluency in spoken Portuguese and English is required.
